Critically Analyzing the Theory and General Concept of Interpretivism Through the Lens of Society

In this piece of writing, I will critically analyze the concept of Interpretation of Statutes, where I will be referring to the famous cases viz, New York State Court’s Riggs Vs. Palmer, A.K Gopalan vs. State of Madras, Maneka Gandhi Vs. UOI. Further, I will also refer to the seminal works of pioneering jurist and sociologer Dworkin and H.L.A Hart. The objective of this work is to analyze the important stake of society whilst deciding the paramount questions pertaining to the judiciary and law.

    JUSTICE DELAYED IS JUSTICE DENIED

As per the recent NCRB (National Crime Record Bureau) report, over 47 million cases are pending before the judiciary awaiting justice, which recently surpassed the 5 crore mark in a report presented by the government in Rajya Sabha from the data retrieved from the Integrated Case Management System (ICMIS) by the Supreme Court of India.1 Furthermore, nearly 90 percent of logjams come from subordinate courts, followed by a considerable amount from the higher judiciary. On top of that, nearly 2 million cases have been pending for the last 30 years before different courts. On average, it takes a decade and more than a half for the disposal of matters related to civil and criminal law, respectively. However, often the number rose to 20, or even more than 30 years in some cases.

Yearning hopes upon a shattered emotions.

It appears to be a bubonic age; feelings pave the way for the return to the crusade of inner reason. Dearth questions the distinction between hegemony and interior engineering, lest it destroy the bond of the crusade, few healing words necessary to be written. Though your teachings are always Herculean and agitated, in my holistic genre, however, fragility supplants and is meant to be a pivot. Yes, I strive and I feel a stigmatization of the agony, nevertheless, what about our plan, fraternity and accreditation? You broke it, right? Why I can't question you? I need to decipher myself. Please come back to me, you promised to be my anodyne; what about that promise? Doesn't that sound like deception?

National solidarity and respect for the martyrs should be kept preeminent by all the citizens and residents irrespective of their role in society.

The freedom, which we got after the violence, strife and persecution of centuries, has different meanings and implications for different strata of society. Apropos, farmers had got freedom from suppressive policies and grave taxation, security of life and liberty to them and their lineage, on the other hand, the privileged and educated population got ample of opportunities to bring changes, to decide the curvature and subsequently, the freedom to pursue their education and skills within the state without any monopoly and duplicity. However, the journey whence we started and now - embedded many stories and frailties, we fought many wars with our immediate neighbours, we clinched and even lost too, but the honour and courage remained invincible. Nevertheless, of poor and fragile onset, India as a state in the 21st century is booming vogue, we have created several records and clinched impertinent heights but what makes us great and flag-bearers of democracy is, - our holy and organic constitution, we as a Parliament perform resilience. However, despite a few erroneous bills and attitudes our honoured judiciary and especially the principle of BASIC STRUCTURE has successfully conveyed the admonition of the supremacy of the constitution and its sacred doctrine subsequently, landmark judgements have paved the way toward a spectacular democracy holding cumulation and patronage towards the citizens and residents.

Changing nature of warfare; despotic government and in the midst of all these the shoving society.

In the midst of global dissonance concerning the fundamental freedom of expression, conscience, press and vigilantism; pioneering democracies, viz. India, the USA and many such states have always perceived it difficult and thwarting. However, the emerging hegemony of China now posing a threatening remark among democracies owing to the fact that CCP censors both economy and civic society’s. Meanwhile, China also leading the fourth-generation warfare and sitting pivotal. However, on the other hand, the ferocious imposition of the national security act over the name of sovereignty and national security has made it further intricate and fragile over the period. Subsequently, vicious political agenda and snollygosters targeting particular groups and society have successfully radicalised and obfuscated wayside.

METAVERSE; a glimpse of the post-internet world and the road ahead.

Out of curiosity, a couple of weeks ago I asked on my Twitter account, that is it possible to design and program a robot, which can run a country, although I got no reaction still, it doesn't seem like an afar fetching journey. Recently, Mark Zuckerberg owned social media giant Facebook has decided to rebrand the company with a new name, hitherto the name is yet to reveal, but most probably the Facebook founder will rebrand the company with METAVERSE.

    Acrimonious Bureaucracy

In Indian system of governance, cabinet is final authority for all administrative matters. higher bureaucracy plays the second fiddle only. Indian constitutions gives some guarantee to the service condition of the incumbent but nothing like independent decision, Higher bureaucracy formulates and advises; Cabinet make final decision. The next job of bureaucracy is to monitor execution of approved schemes.
